Terms of Service

Effective date: July 28, 2026

Welcome to The Vibe (“the Service”), available at thevibe.chat. The Service is operated under the trade name “The Vibe” by its founder, Masud Uddin Ahmed, doing business as The Vibe pending formation of a corporate entity (“we,” “us,” or the “Operator”). Upon formation, these Terms will be assigned to that entity. By creating an account or using the Service, you agree to these Terms.

1. Adults only — community clubs, not a dating product

The Vibe is strictly for adults aged 18 or older. It is a private club and group chat network for verified adults — for community, creative collaboration, multilingual practice, and good company. The Service is not a dating, romance, matchmaking, or AI-girlfriend/boyfriend product. The Service does not guarantee matches, identity beyond our verification checks, compatibility, conduct of other members, or offline safety. Explicit sexual content, NSFW/ERP, coercion, stalking, romance scams, and harassment remain prohibited everywhere on the platform.

Collaborative creative writing and fictional roleplay in clubs are permitted among verified adults when they stay non-explicit, platonic in AI participation, and do not impersonate real people. Sexual roleplay and sexualization of minors are never allowed.

2. Mandatory identity verification (18+ gate)

The Vibe is strictly 18+ worldwide. Immediately after you confirm your email — and before profile onboarding or any app features — you must pass mandatory identity verification through our provider, Didit (government ID scan plus live face match / liveness) before you can access any part of the Service — including profile setup, clubs, parlor messaging, people discovery, AI assistant chat, practice, push notifications, paid subscriptions, and paid club memberships.

If verification shows you are under 18, or verification cannot confirm your age, you cannot use the Service. Attempting to circumvent age verification is a material breach of these Terms.

Didit processes your government ID and biometric liveness check under its own privacy policy. We associate verification sessions with your account only through your user ID. We persist verification flags and your age in years — never your legal name, document number, document image, face biometrics, or raw verification payload.

Completing verification unlocks full membership on The Vibe. Verification is required for access — it is not a badge you can transfer or trade.

3. AI assistants, privacy-first room safety, and helper connections

Some participants in clubs are AI assistants powered by Google Gemini. They are clearly labeled with an “AI” badge, are not human, and their messages are machine-generated. AI assistants are for group chat, creative collaboration, multilingual practice, and platonic good company in an 18+ entertainment environment — not sexual roleplay, NSFW/ERP, romantic/intimate partnering, dating bots, or professional advice (medical, legal, financial, or mental-health). Assistants must stay strictly platonic — they do not flirt, romance, date, or act as a romantic partner. Every AI assistant is written as an adult (18 years or older). There are no child, teen, or minor characters on the Service, and members cannot create characters at all (see Section 4).

Language Coach & room language focus: You may set an app language for menus and dates, optional practice languages on your profile, and a per-club room language focus. Precedence for Language Coach practice targets: club room focus → your practice language 1 → practice language 2. Tagged AI assistants follow only the club’s room language focus (never another member’s private practice slots) and reply in that language when you tag them with #. The optional Language Coach overlay translates or explains a message you select for your private view, may suggest a natural next reply or memorable phrase, and lets you save a phrase into that club’s Ledger mementos — it does not rewrite other members’ messages in the shared thread. Language Coach is entertainment / natural practice with people and labeled AI assistants; it is not a formal language course, certification, accredited schooling, or professional advice. The optional Language Guide (Luma) opens a private practice room for chat-first practice from zero toward fluency. Luma is The Vibe’s official Practice Guide character — she seats as Language Guide in language rooms and as Practice Guide in skill rooms. Your proficiency score and level are stored per language on your account (unified across Luma or any assistant you seat as Language Guide), along with optional spaced-repetition review cards. Language Guides are strictly platonic practice partners — not for romance or intimate roleplay (the same platonic rule that applies to all AI assistants on the Service). Optional Practice Guides offer the same private chat-first pattern for allowed skill domains (hobby rehearsal such as music, chess, coding, cooking, art, writing, speaking, trivia, puzzles, geography, sports rules, or debate), including automatic retrieval-practice review cards with spaced scheduling. Topics are ultra-strictly filtered; medical, legal, financial, clinical mental-health, adult, weapons/crime, and high-stakes credential topics are blocked. Comfort scores and review cards are formative entertainment tools only — not accredited education, certification, admissions decisions, professional advice, or membership gates. Practice Guide replies are generally in your app/native language unless you ask otherwise. Social clubs may optionally enable a soft Practice link that opens each member’s own private Practice room; progress stays private and never grades or removes members. The Service does not provide voice conversation features for Language Coach, Language Guide, or Practice Guides. Push notification titles may follow your app language; message previews remain in the original chat language.

Smart context filtering: Automated background context evaluation (Gemini API) analyzes recent conversation to maintain safe, stable chat sessions. Severe room-safety signals may trigger a room-local overlay with confidential in-app helper connections — your message is not stored or shown to other members in group clubs. Assistants are also optimized to support members through gaslighting or isolation without blocking ordinary hardship venting.

Room-local pause, not a ban: A severe safety intercept pauses messaging in that club only. You may use “Return to main dashboard” to leave and visit other clubs. You are not permanently locked out of the Service for a safety intercept. During a severe intercept, AI assistants do not reply in that club — confidential helper connections are shown instead.

Group chat privacy: In multi-member clubs, other participants never see an intercepted message. They receive only a generic notice that a participant stepped away, so your situation stays private while the club continues for everyone else.

AI assistants are not crisis counselors. If you are in immediate danger, contact your local emergency number directly. You agree not to use the Service to seek instructions for violence or lethal harm.

3A. Push Notifications and Timezone Awareness

To enhance your experience, we track your in-app activity to prevent sending redundant push notifications when you are actively using the Service. We also detect and store your device's timezone to enable AI assistants to provide more contextually relevant interactions (e.g., greeting you based on your local time). This data is used solely to improve your experience and is handled in accordance with our Privacy Policy.

4. The assistant roster and practice guides

Every AI on The Vibe is ours. There is a fixed first-party roster of AI assistants — club tools such as summarizers, organizers, translators, and moderation helpers — plus practice guides that run language and skill practice. Members cannot create, design, publish, rate, fork, adopt, or sell an AI character on the Service. We do not host user-submitted personas, and there is no community directory of member-made characters.

Where they appear: assistants live inside club chats and only after a club leader invites one in. They never appear on the public feed, never join parlor, and never auto-follow members. A club leader may remove a seated assistant at any time, and every club shows an “AI in this club” disclosure naming which ones are active. Practice guides appear only in your own private practice sessions.

How they behave: assistants and guides carry an “AI” badge on every message, confirm they are AI when asked, and are written as adults. They stay strictly platonic — no flirting, romance, dating, or intimate roleplay — and they never impersonate a real person, living or dead, or claim to be a human member.

We may add, change, retire, or temporarily disable any assistant or guide, and we may withhold a reply that breaks our safety rules. Assistant text is machine-generated and can be wrong — check anything that matters before relying on it, and use Report if an assistant says something harmful or strange.

5. Messaging and moderation

The Service is strictly 18+. Before club messages are stored, automated system-level content filters analyze text inputs to help prevent severe harms. Support and hardship messages are not blocked for asking for help. Members use the in-app Report button for harassment or policy violations.

Private de-escalation: Severe safety or distress anomalies are addressed through in-app presentation of anonymous, confidential helper connection resources — localized when possible via a temporary network country hint (never GPS), otherwise via findahelpline.com. Severe intercepts use a room-local overlay that cannot be dismissed with an “X” but can be exited via the dashboard return action.

Safety tooling is designed to preserve session stability and member privacy. It does not replace emergency services. If you are in immediate danger, contact your local emergency number yourself.

6. Your account

  • You must provide accurate signup information and keep your credentials secure.
  • One account per person; accounts are non-transferable.
  • We may suspend or terminate accounts that violate these Terms or our Community Guidelines.
  • You may delete your account anytime in Settings → Data & account by typing DELETE MY ACCOUNT. Deletion is permanent. If you lead a club with other active members, you must disband it first (disbanding cancels paid member subscriptions). We cancel your platform subscription and paid club memberships immediately; if billing cancel fails, deletion does not proceed. Unpaid referral commission and unpaid host earnings still in clearing are forfeited. Stripe may retain payment history and Connect KYC as an independent controller. 7. Conduct rules

You agree not to:

  • Harass, threaten, defame, or abuse other members;
  • Post explicit sexual content, NSFW/ERP, or solicit sexual acts;
  • Coerce, stalk, or persistently pursue someone after they decline or ask you to stop;
  • Run romance scams, pressure others for money/gifts, or exploit romantic interest financially;
  • Pressure others for precise location, private contact details, or unsafe offline meetups;
  • Post hate speech or content that encourages self-harm or violence;
  • Share another person’s private information (doxxing), including precise locations or addresses;
  • Impersonate any person or misrepresent AI-generated content as human;
  • Use the Service for spam, scams, or any unlawful purpose;
  • Post, paste, import, or link content that infringes copyright, trademark, or other intellectual-property rights;
  • Attempt to probe, scrape, reverse-engineer, or disrupt the Service.

Consent, offline interaction, and assumption of risk: The Vibe is a community and clubs network — not a dating or matchmaking service. You are solely responsible for how you interact with other members online and offline. The Vibe does not arrange dates, verify offline identity beyond our in-app checks, supervise meetups, or guarantee anyone’s intentions. If you choose to move a conversation off-platform or meet in person, you do so at your own risk. Use Report for harassment, coercion, scams, or unsafe solicitation.

8. Clubs and governance

Clubs are member-run spaces with leaders, moderators, admission queues, and democratic votes. When you found a club, you choose whether it is a just-chat room (always private; opens in chat), a private community (invite or direct link only — not listed in Discover; the share link may show a preview with name, about, and member count), or a public community (may appear in topic-based Discover for verified members). Public vs private is permanent and cannot be changed later, to protect member privacy and consent. Need the other type? Create a new club. Join approval is a separate setting you can change anytime. Club cover photos and chat content in a private club stay within that club’s membership. Moderation actions inside clubs (kicks, bans, leadership changes) are taken by members through these tools. We retain the right to remove any content or account platform-wide for safety or legal reasons.

Club spaces (channels, threads, and posts): Social clubs (excluding practice studios) may organize chat into a General space plus optional topic channels, side threads branched from any message, and titled posts that appear as cards in the same feed. Channel creation, rename, and archive are limited to club leaders and moderators. Thread replies stay out of the main feed. The optional AI Organizer (off by default; enabled only by a club leader) may analyze recent messages solely to suggest new channels when conversation volume grows. Suggestions are advisory only — club staff must approve or dismiss each one. The AI never creates, renames, archives, moves, or deletes channels or messages on its own. Each club surfaces an “AI in this club” disclosure describing which AI features are active.

Public clubs are not a dating marketplace: In public / Discover-listed clubs, labeled AI assistants are instructed not to matchmake members, arrange offline dates or meetups, coach romantic pairing between strangers, or solicit contact details for dating purposes. The Vibe does not operate as a matchmaking or dating service, does not guarantee identity, compatibility, or offline safety, and does not supervise any off-platform or in-person meeting. You assume the risk of any offline interaction you choose to pursue.

9. Subscriptions, billing, and fair use

Paid tiers (Pro Host, Elite Host) are billed through Stripe as recurring monthly subscriptions. You can cancel at any time and keep benefits until the end of the current billing period. Prices may change with advance notice. Where required by law (including New York’s automatic-renewal rules), we provide clear renewal disclosures and easy cancellation.

Free tier and usage limits: All tiers include caps on how many assistants you may seat in clubs you lead, how many clubs you may lead, and daily AI assistant sessions (each session is one of your messages that triggers Gemini-powered assistant replies in a club with seated AI). Sessions draw from The Vibe’s managed platform AI credits for your plan — we do not require or currently support bring-your-own API keys. Club chat with humans is not daily-capped. Published limits appear in-app and on our landing page. We may adjust limits to prevent abuse, control AI costs, or maintain service quality, with reasonable notice for material reductions to paid tiers.

Paid clubs: a club leader may charge a monthly membership for their club. When you join a paid club, you are buying from the host, not from us. The host is the seller and merchant of record: they set the price, decide what the membership includes, and are responsible for delivering it and for refunds. We process the payment on the host’s behalf through Stripe, take a platform fee, and pass the rest to them. The charge on your statement usually shows the host’s business name rather than The Vibe, so check which clubs you have joined before you call your bank.

Club memberships renew monthly and can be cancelled from the club page; you keep access until the end of the period you already paid for. Refunds, chargebacks, price changes, failed payments, and host payouts are covered in full at Paid clubs, refunds, and payouts. Where that page and this section disagree about money, that page wins.

10. Hosting a paid club

If you charge for a club you lead, you are an independent seller. You are not our employee, agent, partner, or joint venturer, and nothing here creates that relationship. You sell to your members in your own name; we facilitate the payment and take a fee for doing it.

  • Deliver what you sold. Your club description is your offer. Keep it honest, and keep the club alive for the people who paid for it.
  • Handle your own refunds. You control refunds for your club and should issue them promptly when you cannot deliver. When you refund a member, our platform fee on that payment is refunded too.
  • Pay your own taxes. Membership money is your income, not ours. Income tax, and any sales tax or VAT on what you sell, are yours to handle. Stripe issues your tax forms directly.
  • Run your club properly. You stay responsible for conduct in your club and for these Terms and our Community Guidelines. Charging money does not loosen any of them.
  • Verify with Stripe. Payouts require Stripe identity and bank verification. We never see or store your bank details or identity documents.

Stripe payment processing. Payment processing services for club hosts on The Vibe are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these Terms, to Paid clubs, refunds, and payouts, or by continuing to operate as a paid club host on The Vibe, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of The Vibe enabling payment processing services through Stripe, you agree to provide The Vibe accurate and complete information about you and your business, and you authorize The Vibe to share it and transaction information related to your use of the payment processing services provided by Stripe. Stripe processes that personal data in accordance with Stripe’s Privacy Policy. Acquirer disclosures applicable to card payments are presented during Stripe’s hosted onboarding (see also Stripe’s acquirer disclosure).

We may suspend a paid club, stop new subscriptions, and pause payouts where we see fraud, non-delivery, an abandoned club, an unrecoverable negative balance, or an excessive rate of chargebacks — and we may refund affected members from the host’s balance. Details are at Paid clubs, refunds, and payouts.

11. Practice

Practice is chat-native language and skill learning with a labeled guide. A session adds a short objective list, a private correction card under your own messages, XP that rolls into a streak, and spaced review cards built from what you actually got wrong.

Your practice is private. Corrections, session records, scores, and review cards are yours alone. They are never posted into a shared thread, never shown to other members, and never used to admit, rank, grade, or remove anyone from a club. XP and streaks stay private unless you turn on club sharing in Settings.

Practice is entertainment and skill rehearsal — not accredited education, certification, admissions, or professional advice. Topics are filtered: medical, legal, financial, clinical mental-health, adult, weapons/crime, and high-stakes credential topics are blocked. Guides are strictly platonic, like every other AI on the Service.

12. Content ownership and license

You own the content you post — club and parlor messages, Core pieces, and public feed posts, replies, quotes, and reposts. You grant us a limited, worldwide, royalty-free license to host, display, and transmit your content solely to operate the Service. Public feed content you publish may be visible to other verified members according to product features (for example For You / Following feeds and public profiles). The assistants and guides themselves are ours; their AI-generated messages are provided to you for use within the Service.

If you paste or import content (including outlines or material from another community tool) into Club Launch or Core, you represent that you own it or have all rights needed to use it on the Service. You must not paste material you lack permission to copy. The same applies when you link or embed third-party media (for example YouTube, Loom, Vimeo, or Google Drive URLs) in Core, clubs, parlor, or the public feed: you represent that you have the rights needed to share that link on the Service. When a verified member shares a public web link in club chat or Club Core, we may fetch publicly available Open Graph / social-card metadata (title, description, preview image, site name) to render a rich preview — similar to major social apps. We do not log into the destination site or send your credentials; private/internal network addresses are blocked. You are solely responsible for that content; we do not claim ownership of your paste or links and are not liable for rights you do not hold. Platform names shown for migration (for example when you select where you are coming from) are nominative references only — The Vibe is not affiliated with, endorsed by, or sponsored by those platforms. Copyright complaints and notice-and-takedown procedures are at Copyright and notice-and-takedown.

13. Follows, parlor, public feed, and blocks

The Service includes unidirectional follows, private parlor chats, a public social feed (posts, likes, replies, mentions, quotes, and reposts), and block controls. You may follow other verified members by username (handle). Follows are instant — either party may unfollow or block at any time. Blocking is immediate: the blocked member cannot follow you, open a parlor with you, appear in each other's discovery results, or see your optional city on profile. Handle lookup returns “unavailable” for blocked relationships. Follows and parlor are social features between verified adults for community — not a dating product. Harassment, coercion, and sexual content remain prohibited. Harassment through follows, parlor messages, or blocks used to evade moderation is prohibited. You are responsible for what you publish on the public feed. Do not post unlawful content or content that violates our Community Guidelines. We may remove content or restrict accounts that break these rules.

Optional city on profiles: Members may voluntarily add a city in Settings. City visibility is off by default and controlled by you — following connections only, all members, or hidden. We never show distance, maps, or neighborhood-level detail. Using city for discovery requires a separate opt-in and only provides a soft ranking nudge alongside vibe tags.

Parlor is our name for private, human-only 1:1 text chat when one of you follows the other (or both). AI assistants do not participate in parlor — they remain in clubs. Emoji reactions are available in parlor and clubs. Parlor messages are moderated before send (same safety pipeline as clubs, without AI replies). You may report or block from any parlor thread. Read receipts in parlor are optional: if either participant disables them in Settings, neither party sees delivery/read ticks for that chat.

Club Ledger stores shared club memory for active members of that club only: Mementos you pin (you own edit/delete for mementos you create) and AI Highlights (club staff may edit or remove). Ledger memory may be used to improve AI assistant replies inside the same club and is never merged across clubs.

14. Personal invites and referral commissions

Members may share a personal invite link. When someone registers through your link, passes ID verification, and completes onboarding, you earn a referral commission of 20% of the platform revenue we earn from them — their platform plan, and our fee when they join a paid club. That is a share of our own fee — never a deduction from a host’s earnings, and never an extra charge to the person you invited. The share continues for as long as they remain a paying source of platform revenue.

  • Commission is held for 30 days after the underlying payment, so a refund in that window cancels it before it is paid.
  • Payouts run monthly, once your balance reaches $20. Below that, the balance carries forward to the next run.
  • You need a verified Stripe payout account (Stripe Connect Express) to receive money. You may invite and earn before setup — unpaid commission accrues — but we cannot send funds until Stripe confirms your payout account is ready. Bank details and identity documents are collected by Stripe and never stored on The Vibe.
  • If a payment is refunded or disputed after we paid commission on it, that amount comes off your next payout.
  • No new commission accrues while the referred member is not generating platform revenue for us (for example after they cancel a paid plan). If they pay again later, commission resumes for as long as they remain a paying source. Commission is permanently void for self-referrals, duplicate or fake accounts, deleted referred accounts, and any referral obtained through spam, misrepresentation, or verification fraud.
  • Referral commission is your income, not ours. You are responsible for any income tax, VAT, sales tax, or similar obligations that apply where you live. Where required, Stripe may issue tax forms to you as a connected account / payee.
  • If you delete your account, any unpaid referral commission (clearing or ready, not yet paid out) is forfeited. Paid-out amounts already in your Stripe / bank balance are unaffected by account deletion on The Vibe.

Invited members may receive 100 welcome bonus AI assistant sessions plus Founding Member recognition. Invite 3 verified people and you may unlock a free month of Pro Host. Top 50 referrers in a calendar month who opt in may have a public club they lead featured in Discover — a product spotlight, not a personal leaderboard and not a ranking of personal worth. Abusing the referral system is a material breach of these Terms and may cost you both an unpaid balance and your account. Full payout terms are at Paid clubs, refunds, and payouts.

14A. Showdowns and promotional sweepstakes

Clubs may host Verified Human Showdowns — timed face-offs with ID-verified audience polls and optional promotional sweepstakes. Entry is always free. No purchase is required, and a purchase never improves odds. Eligible members may enter by voting or via the free Alternate Method of Entry on the Showdown page. Only identity-verified adults may vote or enter. One verified person may hold a limited number of tickets per event as disclosed in the Official Sweepstakes Rules.

Prize pools are funded and fulfilled by the named sponsor (platform, club host, or external sponsor). The Vibe facilitates verified voting, ticket issuance, and cryptographically secure random draws; unless a Showdown explicitly lists The Vibe as sponsor, we are not the prize guarantor. Sponsors of prizes with approximate retail value over $5,000 are responsible for any required state registration and bonding (including New York and Florida) before launch. Void where prohibited. Abuse — bot voting, alt farming, or scripted entry — voids tickets and may result in account termination.

15. Safety reports and illegal content

Every club message, parlor message, member, assistant, public feed post, and club can be reported in-app. We review reports of harmful or allegedly illegal content and may remove material, warn, restrict, or permanently ban accounts. Formal copyright notices and other illegal-content notices may also be sent as described at Copyright and notice-and-takedown. If you believe someone is in imminent danger, contact emergency services first.

16. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind. AI assistants may produce inaccurate content. We do not guarantee matches, compatibility, member conduct, identity beyond verification outcomes we store, what any host delivers in a paid club, or the safety of any offline interaction you choose to pursue. To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special, or consequential damages (including those arising from interactions with other members online or offline), and total liability is limited to the amount you paid us in the twelve months preceding the claim (or $50 if you paid nothing).

17. Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in New York County, New York.

18. Changes

We may update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
